1. Legal basis

This Cookies Policy has been established based on the legal requirement under Article 173 of the Act of 16 November 2012 on changing the Telecommunications Law Act and certain other acts, i.e. amending the Telecommunications Law Act of 16 July 2004, as amended, and in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

User – any person (Internet user) who visits the Website address (and all sub-pages of the Website) under which the Website is available.

Cookies – computer data, in particular text files, which are stored on the Website User’s terminal equipment and are intended for the use of the Website. Cookies usually contain the name of the website from which they originate, the duration of their storage on the terminal device, and a unique number.

3. Scope of collected information

The Controller informs that the Website collects only the information contained in cookies and does not collect any other data about the User. The Controller declares that the Website does not use tracking cookies which make it possible to track the activities of Users.

Cookies are used for the following purposes:

Adapting the content of the Website to the User’s preferences and optimising the use of web pages. Cookies enable the recognition of the User’s device and correct display of the website, tailored to individual needs.

This notification provides detailed information on the protection of your personal data at HUSSARIA Sp. z o.o. As the Personal Data Controller, we are responsible for collecting and processing your personal data in connection with the conduct of our business, commercial and marketing activities. The purpose of this notification is to inform you about the processing of personal data relating to you that we collect, the reasons for using and sharing such data, the period of its retention, and your rights and how you can exercise them. If necessary, additional information may be provided when you apply to HUSSARIA Sp. z o.o. to perform business / commercial activities. We collect and use your personal data for the period and to the extent necessary in the context of our business, commercial and marketing activities. To protect your personal data, we have appointed a Data Protection Officer.

According to Article 13 (1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), HUSSARIA Sp. z o.o. informs that;

hereinafter referred to as: HUSSARIA Sp. z o.o..

PROCESSING PURPOSE AND BASES:

1) Your personal data shall be processed for the purpose of:

- processing orders and sales of products e.g. at www.electra.hussaria.pl

- HUSSARIA Sp. z o.o. carrying out direct marketing via e-mail, in accordance with the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2017, item 1219), participating in the partner programme, participating in competitions, participating in other marketing actions and promotions.

- HUSSARIA Sp. z o.o. conducting direct marketing via telephone calls and text messages in accordance with the Telecommunications Law Act of 16 July 2004 (Journal of Laws of 2017, item 1907, as amended)

2) HUSSARIA Sp. z o.o. shall process your personal data on the basis of the General Data Protection Regulation of 27 April 2016 pursuant to Article 6(1)(a)/(b)/(c)/(d)/(f). In the case of Article 6(1)(f), the processing is necessary to maintain a close and positive business relationship with our customers.

PERSONAL DATA RECIPIENTS:

3) o the recipients of your personal data may be entities entitled to do so on the basis of specific legislation, at their request and to the extent permitted by law; financial, judicial authorities, state agencies or other public authorities, research and development entities, notified bodies; organisers of trade fairs, certain regulated profession members, i.e. lawyers, notaries, bailiffs. The recipients of your personal data may be service providers performing services on behalf of and to the order of HUSSARIA Sp. z o.o., such as IT companies operating the IT system and the website www.electra.hussaria.pl, the company responsible for surveillance of the premises of HUSSARIA Sp. z o.o., service providers who perform services on our behalf and/or to our order; such as e.g. cleaning companies, printing houses, courier companies e.g. DPD, UPS, electronic payment companies e.g. PayU and other electronic payment operators

Recipients of personal data of the  www.electra.hussaria.pl Online Store’s Customers may include:

- the he selected carrier or intermediary making shipments on behalf of the Controller, to whom the Controller makes the collected personal data of the Customer available, if the Customer opts for postal or courier delivery method in the Online Store;

- the selected entity handling payments in the Online Store, to whom the Controller makes the collected personal data of the Customer available, if the Customer opts for electronic or credit card payment method in the Online Store.

4) Your personal data shall not be transferred to a third country and shall not be transferred to international organisations.

DATA RETENTION PERIOD:

5) we shall retain your personal data for the period required to comply with applicable laws and regulations or any other period relating to our business/commercial activities of HUSSARIA Sp. z o.o.

RIGHTS:

6) You have the right of access to the content of your data and the right to its rectification, erasure (you may request the erasure of your personal data to the extent permitted by law), to restriction of its processing, the right to data portability, the right to object, and the right to withdraw consent at any time without affecting the lawfulness of the processing (if processing is based on consent) that was carried out on the basis of consent before its withdrawal.

7) You have the right to lodge a complaint with the supervisory authority, i.e. the Personal Data Protection Office, if you consider that the processing of your personal data violates the provisions of the General Data Protection Regulation of 27 April 2016.

DATA PROVISION OBLIGATION:

8) to perform the contract concluded with you or to take certain steps at your request prior to concluding the contract, we use your personal data to conclude the contract and to perform our contracts. To this end, we provide you with information on our products and services, assist you and respond to your queries, assess whether we can offer you a product or service and under what conditions the provision of your personal data is a contractual condition and/or a condition for the conclusion of a contract, or resulting from other specific regulations set out in separate legislation.

9) Your data shall not be processed by automated means and shall not be subject to profiling.
